Art 82 dsgvo. Article 82 GDPR: Right to compensation and liability
The supervisory authority shall, without delay, communicate those measures and the reasons for adopting them to the other supervisory authorities concerned, to the Board and to the Commission. When assessing the non-material damages one has to take into account that the defendan has breached serveral rules for a longer period of time with respect to special protected categories of data and has transferred them to third parties. The data subject should be able to exercise that right notwithstanding the fact that he or she is no longer a child. Each supervisory authority shall facilitate the submission of complaints referred to in point f of paragraph 1 by measures such as a complaint submission form which can also be completed electronically, without excluding other means of communication. This Regulation lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data.
- 82 In order to demonstrate compliance with this Regulation, the controller or processor should maintain records of processing activities under its responsibility
- Where administrative fines are imposed on persons that are not an undertaking, the supervisory authority should take account of the general level of income in the Member State as well as the economic situation of the person in considering the appropriate amount of the fine
